Any person ("Visitor") visiting this IOTA website (http://iota-devices.com/, "the Site") undertakes to comply with the terms and conditions described below. It is the Visitor's responsibility to read these terms and conditions, and entering or browsing the Site will automatically constitute acceptance of these terms and conditions.
Purpose, operation and use of the Site
The present terms and conditions of Site use are governed by Polish law. IOTA reserves the right to modify them at any time, in particular to comply with legal or regulatory provisions.
IOTA has introduced its website in order to provide information about itself or the entities with which it is related. The Site does not constitute an offer to purchase nor a solicitation to purchase. The Site contains general information only and the company or its management accept no liability for its contents or accuracy.
IOTA disclaims any liability for problems accessing the Site or interruptions to the connection, as well as any liability regarding the form and content, products or services, advertising and other information and/or data contained on or available from sites that are linked, whether with its authorization or illegally, to the Site.
The creation of hypertext links to the Site or to any of its pages is prohibited without the prior written permission of IOTA.
Intellectual property rights of the Site
The IOTA website is a work that is protected by the law on intellectual property. The Site and each of its components (such as in particular, trademarks, logos, photographs, images, illustrations, texts, videos and other forms) are the exclusive or licensed property of IOTA which alone is authorized to use the intellectual property rights and personality rights therein. IOTA does not grant any license or any right other than to consult the Site. Reproduction of documents published on the Site is authorized solely for informative purposes only. Any reproduction and/or representation and/or use, alone or in combination, in whole or in part of the Site or any of its components, on any media whatsoever, for any purpose other than consultative, including commercial, is expressly prohibited.
In addition, all trademarks quoted or shown on the website are registered and protected. No use of any of the said trademarks can be made without the express prior written consent of IOTA.
Any unauthorized use constitutes an infringement punishable by law.
We warrant IOTA products will be free from manufacturing defects for a period of 12 months following the date of delivery to you. We will replace, repair or credit you for any confirmed defective product at our option. Warranty will not apply if IOTA product fails or is damaged after delivery to you due to accident, abuse or misuse. The warranty does not cover batteries and other parts, which are considered consumables, parts that break easily such as glass or plastic or defects based on normal wear and tear. There is no warranty obligation in the event of marginal differences compared to the target appearance and workmanship provided these have a negligible effect on the product's fitness for use, in the event of damage caused by chemical or electrochemical effects, by water or generally from abnormal conditions.
To the maximum extent allowed under applicable law, except for the express limited warranties set forth above, products are provided “as is” and “as available” and IOTA and its suppliers make no warranties, express, implied, or statutory, by operation of law or otherwise, including, without limitation, any implied warranties of title, non-infringement, merchantability or fitness for a particular purpose or any implied warranties arising out of course of performance, course of dealing or usage of trade under or in connection with the products. IOTA does not warrant that the products will operate error-free, uninterrupted, or that they will be secure. No oral or written information or advice given by IOTA, its agents or representatives or employees shall in any way increase the scope of IOTA product warranty.
PRODUCT RETURN PROCEDURE
To make use of the warranty service, you must send an e-mail describing the issue to the following address: inquiries@iota-devices.com. IOTA team will try to diagnose and solve your issue. If it is determined that a warranty claim exists, you will be given an RMA number (Return Material Authorization) and you will be asked to send the product to IOTA on your expense and risk.
Please observe the following when sending the product:
1. Send the product suitably packaged with shipping and insurance paid. Do not enclose any accessories with the products, unless the IOTA team specifies otherwise.
2. Mark the RMA number on the outside of the package in such a way that it is visible and clearly legible.
3. Once IOTA has received the product, it will meet its warranty obligations in accordance with the warranty conditions and will return the product to the sender with carriage and insurance paid.
In case it is proven a returned product is not faulty, you will be obliged to pay for the carriage and insurance to return the product to you.
NO LIABILITY
To the maximum extent permitted under applicable law, IOTA shall not be liable to you, or any third party, for any indirect, exemplary, special, consequential or incidental damages of any kind arising in any way out of use of IOTA products, including, without limitation, loss of profits, revenues or data, or costs of replacement goods, even if IOTA has been advised of the possibility of such damages and notwithstanding the failure of any limited remedy of its essential purpose.
CONFLICTS OF TERMS
The above terms are valid in case you order IOTA products and pay for them even if your purchasing procedures, including expected warranty terms and return procedures, are different.
REVISIONS TO THESE TERMS
These terms are applicable for any IOTA products delivered from 1 January 2015 on.
Personal data is information about you personally such as your full name, address, telephone or fax number, email address or any other information you provide to us. This information is collected with your consent, you also can refuse to communicate it.
Non-personal information is information on how you access the Site, such as the type of browser you are using or your ISP. This data is automatically collected when you access the Site, unless you have configured your browser to refuse cookies (see below) or it prompts you for permission before installing such files.
EVERY EUROPEAN DIGITAL may be required to collect personal data about the Visitor, in particular when the latter is registering for our newsletter or completing contact forms. This personal data will be processed automatically and may be used to contact you or send you information.
EVERY EUROPEAN DIGITAL may place a ‘cookie’ in the Visitor's computer to identify it. Cookies are small files placed on your computer to automatically record information relating to the navigation of the website by the Visitor.
